中华人民共和国政府和美利坚合众国政府关于互免海运、空运企业运输收入税收的规定
中华人民共和国政府和美利坚合众国政府，就海运、空运企业的运输收入互免税收问题，达成协议如下：
第一条
缔约一方的企业在经营海运、空运国际运输中的业务收入、利润只在该缔约国纳税。
第二条
一、 海运、空运业务的收入和利润包括：
（一） 由船舶或飞机的所有者或租用者经营的客运、货运和邮政运输业务的收入和利润，以及有关于上述运输票证出售的业务收入和利润。
（二） 出租者在国际运输中经营出租船舶或飞机的租金收入和利润。
（三） 在经营海运、空运国际运输业务中附带有出租船舶或飞机的租金收入和利润。
（四） 在国际运输中出租或使集装箱（以及运输集装箱有关设备）的收入和利润。
上述一至四款所得收入和利润是指由缔约一方企业所取得的收入和利润。
二、 国际运输是指船舶或飞机运输，仅发生在缔约另一方各地之间的运输不包括在内。
第三条
转让在国际运输中经营的船舶、飞机或集装箱的利得，应仅在该缔约国纳税。
第四条
一、 上述企业是指：
（一） 中华人民共和国的国营、集体所有制企业，以及由中华人民共和国的居民经营的企业。
（二） 在美利坚合众国组成的公司经营的企业，以及美利坚合众国的居民经营的企业。
二、 上述第一款所指的企业也包括它参加的合伙与合营的企业。
第五条
缔约一方的居民在经营国际运输的船舶或飞机上被雇为船员或机组成员、其工资、劳务所得在缔约另一方应予免税。
第六条
缔约双方主管当局在解释或实施本协定时，如发生困难或疑义，应相互协商，寻求解决。
第七条
本协定规定并不阻止缔约一方对其居民和公民征税。
第八条
本协定应在缔约双方完成各自的法律程序后，通过外交途径以书面通知对方。本协定应自最后一方通知之日起生效。
本协定各条款从１９８１年１月１日起有效。
第九条
本协定长期有效，但缔约任何一方均可提前六个月通过外交途径书面通知对方予以终止，本协定将在满六个月以后的１月１日起不再生效。
本协定于１９８２年３月５日在北京签订，共两份，每份都用中文和英文写成，两种文本具有同等效力。

《中山市查处违法建设联席会议制度》业经市政府同意，现印发给你们，请贯彻执行。

中山市查处违法建设联席会议制度
第一条 根据市政府《关于建立查处违法建设长效机制的意见》（中府〔2007〕90号，下称《意见》）精神，为有效制止违法建设行为，巩固全国文明城市创建成果，营造良好的发展环境，全面建设“两个适宜”和谐中山，确保查处违法建设工作顺利开展，制定本制度。
第二条 市查处违法建设联席会议是市政府查处违法建设工作的非常设机构。
根据《意见》规定，市政府建立查处违法建设联席会议制度，由市政府分管城建规划的副市长为市查处违法建设联席会议制度第一召集人，市政府分管城建规划的副秘书长为第二召集人，各镇区分管城建的副镇长（副主任）和市国土、规划、城管执法、水利、林业、交通、公路、农业、建设、公安、消防、环保、安监、工商、卫生、流动人口办、供电、供水等单位分管领导为会议成员。
市查处违法建设联席会议办公室设在市城市管理委员会办公室，承担联席会议日常工作。市城管办副主任、城管执法局局长兼任办公室主任，市国土、城管执法、规划、水利、林业、工商、卫生、环保、供电、供水等部门分管领导为办公室副主任。
第三条 市查处违法建设联席会议工作任务：
（一）按照《意见》要求，督促、协调、指导各成员单位履行法定职责，开展全市性查处违法建设工作。
（二）定期或不定期召开会议，分析全市查处违法建设工作情况，及时研究解决存在问题。协调相关重要事项，制订工作对策，为市政府提供决策依据。
（三）建立国土、规划、城管执法、水利、林业、交通、公路、农业、建设、公安、消防、环保、安监、工商、卫生、流动人口办等部门参加的定期联合检查制度。由市查处违法建设联席会议办公室根据《中山市违法建设专项整治量化考核细则》，每半年组织对镇区违法建设查处情况进行一次检查，每两年进行一次考核。
（四）完成市政府交办的其他工作任务。
第四条 市查处违法建设联席会议由第一召集人或第二召集人组织召开，每年召开一次。会议时间、地点、议题等由联席会议办公室草拟第一召集人或第二召集人批准，并提前5天通知各成员单位。
市查处违法建设联席会议成员应按时出席会议，如不能出席，应向联席会议第一召集人或第二召集人请假，并安排本单位相关领导代为参加。
市查处违法建设联席会议成员单位应向联席会议汇报本单位查处违法建设工作的开展情况并提供书面材料。市查处违法建设联席会议办公室应安排专人做好会议记录，会后形成会议纪要。联席会议形成的共识及所作决定，各成员单位必须认真落实，并在会后20天内将落实情况书面报联席会议办公室，由联席会议办公室汇总后报市政府。
第五条 市查处违法建设联席会议办公室要及时将每半年对镇区检查违法建设的查处情况、每两年的考核结果报市政府。
第六条 建立市查处违法建设联席会议联络员制度。各镇区城管办主任和市国土、规划、城管执法、水利、林业、交通、公路、农业、建设、公安、消防、环保、安监、工商、卫生、流动人口办、供电、供水等有关单位确定相关科室抽调1名业务骨干为联络员，负责完成联席会议及办公室部署的相关工作任务。各成员单位联络员应保持相对稳定，人员调整时应及时报知联席会议办公室。
第七条 市查处违法建设联席会议成员单位应认真履行查处违法建筑建设的职责，增强大局意识和责任意识，按照联席会议部署开展工作，认真遵守联席会议制定的各项制度，带头执行联席会议作出的各项决定，履行成员单位职责和任务。各成员单位职责、任务按照《意见》要求执行。
第八条 各镇（区）参照本制度建立相应的查处违法建设联席会议制度，负责协调相关工作。
第九条 本制度由市查处违法建设联席会议办公室负责解释。
第十条 本制度从2007年10月1日起实施。
